HB 1080 was referred to the House Rules Committee on February 3, 2011 and moved to the Agriculture & Conservation Committee on February 8, 2011.

SYNOPSIS AS INTRODUCED:
510 ILCS 5/15 from Ch. 8, par. 365
510 ILCS 5/24 from Ch. 8, par. 374 

Amends the Animal Control Act. Removes the ban on classifying vicious dogs based on breed. Effective immediately.

(510 ILCS 5/15) (from Ch. 8, par. 365)

No dog shall be deemed “vicious” if it is a professionally trained dog for law enforcement or guard duties. Vicious dogs shall not be classified in a manner that is specific as to breed.

 (510 ILCS 5/24) (from Ch. 8, par. 374)

Sec. 24. Nothing in this Act shall be held to limit in any manner the power of any municipality or other political subdivision to prohibit animals from running at large, nor shall anything in this Act be construed to, in any manner, limit the power of any municipality or other political subdivision to further control and regulate dogs, cats or other animals in such municipality or other political subdivision provided that no regulation or ordinance is specific to breed. Morton, IL: Resident requests BSL

Illinois state law prohibits municipalities from passing BSL. Morton is not “home rule” and therefore cannot pass laws that contradict state law.

MORTON — Carrie Schmidt wants the village to adopt a vicious dog ordinance.[...]

The Mackinaw resident listed eight preventative measures she’d like to see included on a vicious dog ordinance, which would apply only to breeds considered dangerous.

Measures include limiting the number of dangerous breed dogs per household, special training for the dog and owner, significant liability insurance, village-approved dog fencing, and stiff penalties for violations.[...]

Mayor Norm Durflinger instructed village attorney Tom Davies to draft an ordinance that will be considered at the Jan. 3 board meeting.

ELGIN — It has been about three months since the city enacted a tougher animal-control ordinance designed to curb a growing number of dog-related incidents in recent years.

Although questions remain about whether the new rules will reduce the number of complaints against loose and dangerous dogs, city officials already have credited the ordinance with raising awareness by dog owners and the police officers charged with identifying violations.

Neither Bush or Hurst, Illinois are “home rule” cities, which means state law prohibits them from passing BSL. Nevertheless, those in the area need to reach out to the officials in both communities to provide suggestions and good non-breed specific ordinances for their consideration.

Communities Discuss Banning Vicious Dogs

WILLIAMSON CO. –  Harvel brought his concerns to the Hurst City Council. While the council appeared in support, some in the community disagreed…. At the Bush Village Hall, the community is also divided. … Both communities expect to have an ordinance drafted by the next meeting, and ready to take a vote.
