Oktibbeha County, MS: Council asks for public comment on vicious dog ordinance, Sept 6

Oktibbeha County, MS, intends to schedule public hearings to gather local input about a possible dangerous/vicious dog ordinance. Though they do not have an official proposal ready for discussion, the county board also expects to take public comment and suggestions during the September 6 board meeting.

The county currently does not have a leash law or dangerous/vicious dog ordinance. It is not clear at this time exactly what kind of law residents will request. However, StopBSL feels that there is a possibility that the residents at the Sept 6 board meeting will request BSL or a breed ban.

Fortunately, the county board does not seem inclined toward breed-specific measures—but nevertheless, the Oktibbeha County Board of Supervisors could probably use some public encouragement to maintain a breed-neutral course. VERY important: keep correspondence respectful and informational; the county board has not expressed interest in breed-specific laws and several board members have made statements against breed-based discrimination. Please commend them and encourage them to continue thinking this way.

Oktibbeha to schedule public hearing for vicious animal ordinance

STARKVILLE — In anticipation of public pressure to adopt a vicious animal ordinance, the Oktibbeha County Board of Supervisors plans to schedule public hearings about the issue at Tuesday’s meeting.

Following a pit bull attack on two children on Self Creek Road on Aug. 13, the board has studied ordinances in Pontotoc and Lowndes counties. [...]

The board’s agendas and minutes are not posted online, and news coverage hasn’t been the most reliable source. Ideally, a resident or local could make a special effort to stay in contact with the Chancery Clerk or the County Board of Supervisors in order to stay on top of developments.

Pit bulls, crocodiles and panthers targeted in Egelston Township’s proposed dangerous animal ordinance

Pit bulls would have to be kept indoors or in a covered kennel and walked with a muzzle under a new ordinance proposed in Egelston Township.

The township board is expected to discuss the ordinance, which was prepared by the planning commission, at its Sept. 19 meeting.

Based on Muskegon Township’s ordinance, the proposal targets dangerous animals ranging from wolves to poisonous snakes to elephants. But the primary target of the ordinance are pit bulls, also known as American pit bull terriers or Staffordshire bull terriers, or dogs with the “appearance and characteristics of being predominately” pit bull. Oktibbeha County, MS: Whispers of BSL

Oktibbeha County, MS, currently does not have a leash law or dangerous/vicious dog ordinance. Over the last few years, dog bites (some severe) have made headlines—particularly “pit bull” bites—and on these occasions residents have asked the board to enact dog laws. Some of the board members have also looked into the dog laws of surrounding areas. Several board members and the county attorney have stated in the past that they do NOT want proposed dog laws to be breed-specific.

Despite ongoing dialogue about the need for county dog laws, the county remains without any kind of leash law or vicious dog law. A recent highly-publicized “pit bull” incident in the county has residents once again calling for county-wide vicious dog laws. The residents intend to approach the county board at the next board meeting, which should be September 5.

It is not clear at this time exactly what kind of law the residents will request, nor is it clear whether the board of supervisors will answer the call. However, considering the persistent requests for an ordinance and the news media’s focus on “pit bull” attacks specificially (which also focuses the public’s outrage on “pit bulls”), StopBSL feels that there is a possibility that the residents at the Sept 5 board meeting will request BSL or a breed ban.

Niles Township, MI: Town considers ordinance that prohibits breed discrimination

**Not to be confused with Niles, MI**

Update 9/20/11: The ordinance was passed with some changes. I have not confirmed whether the prohibition against breed discrimination remains intact; but I have not read anything that suggests it was removed.

Niles Township, MI, is considering a new animal control ordinance after a loose dog attacked a cat and another dog. While such incidents, when committed by certain types of dogs, usually inspire breed-specific ordinances, the draft ordinance currently being worked on in Niles Township says just the opposite.

The current draft reads: “No animal shall be found to be a dangerous animal solely because it is a particular breed.”

This is currently a draft. The township board supervisor advises that the draft is undergoing changes; he hopes to have a final draft ready for a first reading at the August 15 township board meeting.

Please write the Township and show your support for breed-neutral language. Encourage them to keep this prohibition against breed discrimination!

Ventura County, CA: Breed-specific mandatory spay/neuter ordinance suggested

Breed-specific mandatory spay/neuter is breed-specific, and therefore carries with it all the flaws and inequalities of any law based strictly on what a dog looks like.

Ventura County Animal Services, headed by director Monica Nolan, is proposing the ordinance.

Ventura County Animal Services considers ordinance to spay or neuter pit bulls

[...] Nolan said Ventura County’s ordinance would either be modeled after San Francisco County’s or San Bernardino County’s. There, owners are given a period of time to spay or neuter their pit bull after a first warning. In San Francisco city and county, a first violation would include a fine not to exceed $500. In San Bernardino, owners are fined $100 for the first violation, with subsequent offenses garnering up to $500 in fines.

Under Ventura County’s proposed ordinance, pit bulls that are registered with the American Kennel Club or the United Kennel Club would be exempt, Nolan said. In San Francisco, pit bulls under 8 weeks of age are exempt, as are dogs that cannot be spayed or neutered without suffering a serious injury or death because of a physical abnormality.[...]

Charles County, MD: Citizens object to proposed BSL, discussions moved to Sept

Charles County, MD, held a work session last night on proposed animal ordinance revisions that include breed-specific language. Dozens of citizens attended the work session to object to BSL. The commissioners also acknowledged a high volume of correspondence in opposition to the proposal. The proposal generated so much opposition that the commissioners decided to extend the work session to tonight so that all participating citizens could have their say (presumably during the Public Forum at 5:00 PM today, July 27). The Charles County Board of Commissioners plans to discuss this proposal again in September. StopBSL will check the posted agendas and will issue an alert when it appears on the agenda again.

Surprisingly, news media coverage of this proposal has been largely non-existent. The Charles County news media did not mention the proposal or the upcoming work session, nor has it mentioned the results of the work session. Thankfully, in spite of media silence, residents got tipped off by other sources and turned up in large number.

StopBSL would like to commend the efforts of the residents (and nonresidents) who passed around the initial alert, who attended the meeting, and who reported on the meeting’s results. Particularly in the absence of media coverage, clearinghouses like StopBSL rely heavily on residents and locals to report on BSL-related issues.

Charles County, MD: Work session to discuss proposed BSL, July 26

Charles County, MD, board of commissioners will hold a work session on July 26 to discuss changes to their animal control ordinances. One of the major revisions would declare all “pit bulls” to be “potentially dangerous” dogs, thereby placing numerous special restrictions on ownership of dogs identified as pit bulls.

“Pit bull” is defined as American Pit Bull Terrier, American Staffordshire Terrier, Staffordshire Bull Terrier, American Bulldog, any dog that has ever been identified at any time (including in adoption or veterinary paperwork) as a “pit bull” type dog, and any dog that resembles one of these breeds.
