Pennsylvania: HB 671 would allow BSL

Update 6/6/09: Galloway has rewritten the bill. The new bill number is HB 1243. The language retains the statewide prohibition against BSL. HB 1243 can be tracked here: Because BSL is no longer a possibility with this bill, it is being dropped from the statewide alert list.

Rep. John Galloway is trying to pass BSL again.

Pennsylvania HB 671, introduced by Rep. Galloway and referred to the Committee on Agriculture and Rural Affairs, would remove the statewide prohibition against BSL and permit municipalities to pass BSL.

The section of the proposed legislation that would allow this is below. The underlined section is the text that would be added to current law.

(c) Local ordinances.–[Those provisions of local ordinances relating to dangerous dogs are hereby abrogated.] A local ordinance otherwise dealing with dogs may not prohibit or otherwise limit a specific breed of dog. This act shall not supersede or preclude the adoption of any municipal ordinance applicable to dangerous dogs.

What this means, in plain English, is that municipalities (cities) can’t institute breed bans or other breed-specific legislation except when it comes to “dangerous” dogs–then they are free to implement BSL.

    I just drafted my letter and will send it out to all committee members this week. Thanks for keeping this site up-to-date and filled with good information to help form replies and letters. It is much appreciated!

  4. Galloway has done a rewrite of this bill, which will be released soon. This bill has the approval of many Pit Bull and animal friendly organizations. It has closed the loopholes that were in the original version of the bill. Since the original 671 has been pulled, please do not email him to protest it.

    I hope that people will take initiative to thank Galloway for working to be sure that PA stays BSL free once the new bill is introduced.

    Dangerous dog laws are needed to keep us safe from BSL. Often, areas that have insufficient laws to protect communities from dogs who are unsafe have knee jerk reactions to news stories, or turn to BSL out of frustration.

  5. Can anyone tell me the latest on 671? I don’t yet see a re-write. Also, what about HB 1243?
