Illinois HB1080: Re-referred to Rules Committee

October update: HB1080 is most likely dead. There has been no effort to revive it.

Illinois HB1080, which would allow all municipalities to pass BSL in Illinois, was re-referred to the Rules Committee on March 17. Illinois residents should continue to contact their legislators and the Rules Committee legislators to oppose HB1080.

What happened: March 17 was the deadline for all House bills to report out of committee. All bills that did not report out of their assigned committees by the deadline, including HB1080, were returned to the Rules Committee, per Rule 19(a).

What could happen next: Some people call Rules Committee re-referrals “the graveyard where bills go to die.” It is certainly possible that the bill will die here. However, if the Rules Committee perceives that the bill has enough support in the legislature, the Rules Committee may choose to move the bill to the House floor for debate and vote. For this reason, it is critical that Illinois residents continue to contact both their own legislators and the Rules Committee to oppose HB1080.

In your correspondence to legislators, please remain BRIEF and POLITE. Hundreds of bills were re-referred to the Rules Committee on Friday. The committee members aren’t likely to be familiar with every one of these bills.

Illinois state law currently prohibits municipalities from passing breed-specific laws. HB 1080 would undo this prohibition and permit any municipality to declare dogs dangerous based on breed. HB 1080 has recently gained an amendment and a co-sponsor, Rep. Jehan A. Gordon.

The Agriculture & Conservation Committee hearing on HB 1080 has been moved to March 15. Residents, please attend the committee meeting on Tuesday, March 15, and express your opposition to House Bill 1080.

SYNOPSIS AS INTRODUCED:
510 ILCS 5/15 from Ch. 8, par. 365
510 ILCS 5/24 from Ch. 8, par. 374 

Amends the Animal Control Act. Removes the ban on classifying vicious dogs based on breed. Effective immediately.

(510 ILCS 5/15) (from Ch. 8, par. 365)

No dog shall be deemed “vicious” if it is a professionally trained dog for law enforcement or guard duties. Vicious dogs shall not be classified in a manner that is specific as to breed.

Sec. 24. Nothing in this Act shall be held to limit in any manner the power of any municipality or other political subdivision to prohibit animals from running at large, nor shall anything in this Act be construed to, in any manner, limit the power of any municipality or other political subdivision to further control and regulate dogs, cats or other animals in such municipality or other political subdivision provided that no regulation or ordinance is specific to breed. Illinois state law prohibits municipalities from passing BSL. Morton is not “home rule” and therefore cannot pass laws that contradict state law.

Morton woman asks Village Board to craft vicious dog ordinance.

MORTON — Carrie Schmidt wants the village to adopt a vicious dog ordinance.[…]

The Mackinaw resident listed eight preventative measures she’d like to see included on a vicious dog ordinance, which would apply only to breeds considered dangerous.

Measures include limiting the number of dangerous breed dogs per household, special training for the dog and owner, significant liability insurance, village-approved dog fencing, and stiff penalties for violations.[…]

Mayor Norm Durflinger instructed village attorney Tom Davies to draft an ordinance that will be considered at the Jan. 3 board meeting.
