Rhode Island HB5671, a bill to prohibit breed discriminatory laws set for committee

Rhode Island legislators are looking at a bill that would prohibit municipalities in the state of Rhode Island from enacting breed discriminatory laws. HB5671 would amend the current laws to include a section that states:

“No city or town may enact any rule, regulation or ordinance specific to any breed of dog, cat or other animal in the exercise of its power to further control and regulate dogs, cats or other animals as authorized by this chapter.”

This bill is coming fresh on the heels of another bill that was introduced that would have restricted certain breeds of dogs and dogs that resemble those breeds. That bill was pulled very quickly because of the huge out pouring of opposition to breed discrimination.

Legislators will have this in their minds as they hear this bill, but it is extremely important that Rhode Island residents reach out to their legislators to ask them to support this bill.

The bill is on the House agenda for Thursday May 9th at approximately 4:30.

Rhode Island bill HB5671 introduced to prohibit breed specific legislation on the state level

On February 27th a bill was introduced in Rhode Island, at the behest of the Defenders of Animals,  that would create a statewide prohibition against BSL.  HB 5671 has been assigned to the House Judiciary Committee though no date has been set yet.

HB 5671 is a very simple bill that states:

“4-13.1-16. Prohibition of breed specific regulation. — No city or town may enact any rule, regulation or ordinance specific to any breed of dog, cat or other animal in the exercise of its power to further control and regulate dogs, cats or other animals as authorized by this chapter.

Rhode Island residents: It is extremely important to reach out to your legislators to ask them to support this bill. After the recent issue with the bill to restrict pit bull type dogs on the state level, and the out pouring of opposition, now would be the best time to get this bill passed.  Law makers will have that fresh in their minds when they hear this bill. However, it is just as important that those who reached out to oppose that bill reach out to support this one.

Please be professional and polite in all communications. Reach out especially to the bills sponsors, Representatives Palangio, Williams, Palumbo, Lima, and DeSimone to thank them for bringing this forward to protect the communities of Rhode Island from pit falls of BSL.

Best Friends alert for Rhode Island

Best friends Animal Society has issued a formal alert to counter the bills that have been introduced in Rhode Island.  SB178 and HB 5287 are companion bills who goal is the same, to create severe restrictions on pit bull type dogs.

Included in these bills are mandatory insurance, confinement, muzzling and several other severe restrictions.  These bills would create statewide breed specific legislation.

Rhode Island residents: Use the link to the Best Friends action alert to reach out and add your voice to the opposition to this bill.  There must be a strong, loud and clear chorus telling legislators to oppose both of these bills.

Since Ohio’s state law fell last year these is no other precedent for a state law.  If these were to pass the an example would be set that we cannot allow.

Rhode Island Action Alert

Residents of Rhode Island, your quick action is needed.

A bill has been introduced that would create regulations for pit bull type dogs on the STATE level, much like the recently repealed Ohio law.

SB 178 would regulate the care and control of “pit bulls” including requirements for insurance, confinement and muzzling.

One of the more outrageous portions of this bill…

“(a) Signs Required. Every veterinary office, kennel, commercial breeder, commercial animal establishment, pet shop and dog grooming business must post a sign stating in English, the following:

“BOTH PURE AND MIXED BREED PITBULL DOGS ARE CLASSIFIED AS DANGEROUS. FAILURE TO REGISTER, MUZZLE, CONFINE, AND INSURE A PITBULL IS A VIOLATION OF THE LAWS SUBJECT TO PENALTY. Chapter 4-13.1 of the Rhode Island General Laws.

“IF YOU OR YOUR FAMILY IS AT RISK BECAUSE SOMEONE LIVING NEAR YOU FAILS TO CONFINE, MUZZLE OR INSURE A PITBULL DOG, CONTACT THE ANIMAL CONTROL OFFICER” (HERE INSERT CURRENT PHONE NUMBER FOR THE LOCAL ANIMAL CONTROL OFFICER).

The sign must be prominently displayed to the public and clearly legible.

(b) Penalties. Failure to post a sign as required by this section shall be a civil violation subject to a one hundred fifty dollar ($150) civil penalty. Every day a sign is not posted shall be a separate violation.

This bill has been referred to the Senate Environment & Agriculture Committee.

Woonsocket, RI – Officials Table Pit Bull Discussions

Woonsocket officials tabled proposed legislation on pit bull dogs noting that they wish to work more closely with pet owners in effort to create a solution that balances the interests of responsible pet owners and the need to protect the public from vicious dogs.

“The idea is to be a little more comprehensive about the problem rather than slapping together an ordinance we might have trouble enforcing,” Said City Council President John Ward.  Ward had proposed an ordinance similar to Pawtucket’s breed-specific ordinance, banning any new pit bulls from being licensed and forcing existing pit bull owners to obtain $100,000 worth of liability insurance.

If you are in the Woonsocket area, please make contact with your officials in effort to work with them in developing a breed-neutral Dangerous Dog ordinance.  You can reference our model ordinance if Council is open to suggestions for enforceable, effective community safety guidelines.

In an attempt to curb the city’s population of pit bulls and other “fierce, dangerous or vicious” dogs, City Council President John F. Ward has proposed an ordinance that will prohibit any new pit bulls in the city after the ordinance is passed.

Existing pit bulls would be permitted to register prior to passing the ordinance, allowing them to remain within the city limits, but owners would have to obtain $100,000 liability policy as well as meet additional requirements to legally own the dogs.

This knee-jerk reaction comes at the heels of an incident last month that involved an alleged pit bull in which three people were injured with bite wounds.

According to Council President Ward, the police department has requested repeatedly that Woonsocket officials enact breed specific legislation because ‘we have pit bulls all over the city’.  Ward says “They think it would make it safer.”

In addition to the registration requirement and liability insurance, the new ordinance would require mandatory spay/neutering of ‘pit bulls’, “escape-proof” containment on the owners property, and muzzled and leashed or in a temporary enclosure when off the owners property.  

The proposed ordinance is structured on the near-by Pawtucket ordinance that was passed several years ago.  Ward states that while the matter is on the agenda for the Council’s Monday night meeting, it will likely be tabled for sometime in effort to provide council members time to discuss the proposal, gather feedback from police, pet owners and Animal Control Officer Doris Kay, as well as invite Pawtucket Animal Control Officer John Holmes to talk with council about how the law is working in his city.

“Pit Bull” is defined as American Pit Bull Terrier, American Staffordshire Terrier, Staffordshire Bull Terrier, or any dog of mixed breed displaying the majority of physical traits of any one or more of the above breeds.”
