Denver, CO: Council set to consider service dog exemption to pit bull ban, Dec 6

The Denver city council is set to consider a service dog exemption to their pit bull ban. The Department of Justice recently issued an opinion that service dogs could not be restricted or banned based on their breed. Denver is also facing several lawsuits from people with pit bull service dogs.

Will Denver actually consider the exemption this time? Or will they continue to put the discussion off?

Aurora, CO: ADA helps veteran keep service pit bull

There’s a great video at the story link. The article title leaves something to be desired; I sure wouldn’t call the Americans with Disabilities Act a “loophole.”

AURORA, Colo. — He served in Vietnam and had 53 confirmed kills. Those days and nights he spent on the battle field left him with Post-Traumatic Stress Disorder, an illness that is allowing him to beat Aurora’s Pit Bull and Dangerous Dog laws.

A new ruling now indicates that a service dog is any dog that complies with revised ADA regulations.

Regulations indicating that no city can pass laws which prohibit a disabled person from keeping a pit bull or restricted breed as a service dog, effective March 15, 2011.[…]

Denver, CO: Council continues to delay vote on service dog exemption to ban

In August, the safety commmittee recommended that Denver city council create an exemption in the pit bull ban for “pit bull” service dogs. This recommendation was made in part due to several lawsuits and a Justice Department ruling stating that the ban violated the Americans with Disabilities Act.

Since August, Denver city council has had multiple opportunities to read and vote on the service dog exemption. Instead, they have consistently delayed any action for months. The council is to consider the exemption again on Dec. 6.

The ADA ruling trumps breed-specific ordinances in cities such as Denver and Aurora. Denver first banned pit bulls in 1989 after reported attacks and reinstated the legislation in 2005.

With the ADA ruling in place, City Councilwoman Carla Madison now hopes council could make further exemptions for residents who comply with certain criteria, proving their dogs are well-behaved.

The Denver City Council on Monday delayed a vote on whether to create an exemption to the city’s pit-bull-terrier ban that would allow the disabled to use the dogs as service animals.

Aurora is finally realizing the same thing Denver has recently realized: their breed ban violates the Americans with Disabilities Act.

Aurora ponders permitting pit bulls as service dogs

AURORA | City officials could discuss the possibility of amending an ordinance to allow pit bulls as service dogs in the city at an executive session as early as Oct. 11, according to a city attorney.

The announcement of the meeting comes after officials from the U.S. Department of Justice said earlier this summer that any dog that is trained to do work or perform tasks for disabled people should be classified as a service animal, under the Americans with Disabilities Act.
